Legal Action vs Monterey County

STRs are Imminently Threatened

  • MCVRA has pleaded with Monterey County for over 7 years for a reasonable short term rental (STR) ordinance.
  • MCVRA has attended countless meetings with County staff, Planning Commissioners, and Supervisors.
  • The County has drafted 5 different versions of ordinances.
  • Every version has proposed an unacceptable, onerous use permit process for most STRs.
  • And any ordinance, good or bad, still remains far into the future.
  • After dragging its feet for years, the County now plans to proactively enforce its current code “interpretation” that every unpermitted STR is illegal.
  • On October 5, 2021, the Board of Supervisors approved a Pilot Program enforcement policy that will shut down every STR in Supervisor District 5. This includes Pebble Beach, Big Sur, Carmel Highlands, Carmel Valley, and surrounding areas. About 82% of all Monterey County STRs are in District 5.
  • No complaint or nuisance will be required to issue a citation.
  • Host Compliance will be utilized to find your advertisements.
  • Your TOT payment records will be utilized to find you.
  • Since there is no workable permit process in either the inland or coastal areas, this Pilot Program is a ban.
  • The Board of Supervisors will hear the details of the Pilot Program on December 8, 2021
This Left Us No Choice - We MUST Take Legal Action
  • MCVRA and a few STR owners have formed a legal committee.
  • An attorney has been retained.
  • WE MUST STOP THE PILOT PROGRAM.
  • If the Pilot Program is initiated, STR opponents will love it and will fight even harder against any draft ordinance that would permit STRs.
  • The Pilot Program will spread to all areas of the county.
